Description:

Legal acts. Prescription. Formation of contracts. Liability for material and legal defects of performance, deposit, right of retention; guarantee, contractual penalty. Modification in obligations (subjects and content). Termination of obligations. Liability for damages. Contracts.

Knowledge and understanding

After successful completion of the course students will be able to:

- define civil law system,

- define and explain individual institutes and concepts of the general part of civil law (the concept, system and principles of civil law, sources of civil law, civil law relation, subjects of civil law relation, civil law in subjective sense, objects of civil law, legal affairs).

- define and explain the system and institutes of law of obligations (the concept of law of obligations, concept and types of obligations, the concept of concluding contracts, categories and types of contracts, individual names contracts, liability for damage, other non-contractual obligations).

- explain the scope of application of legal rules and prerequisites for the application of individual legal institutes of civil law - general part and the law of obligations).

- explain why certain requirements are legally prescribed for the creation of individual legal relations and the purpose of individual institutes.

- explain why individual institutes of civil law and law of obligations are applied in certain life situations.

 

Application

After successfully completing the course, students will be able to:

- properly interpret rules that regulate general part of civil law and law of obligations

- solve the problem of legal gaps

- determine which legal rules are relevant for solving a concrete case

- apply legal rules to concrete life situations

 

Analysis

After successfully completing the course, students will be able to:

- analyse legal sources and legal rules that determine the subject matter of the general part of civil law and law of obligations

- connect legal rules that regulate individual civil law institutes

- analyse points of fact and distinguish relevant from irrelevant facts in order to properly apply legal rules

 

Synthesis

After successfully completing the course, students will be able to:

- connect relevant facts with legal rules and on the basis of that determine the rlender may demand from the borrower

- critically consider the position of parties in the legal relationship, and decide which are advantages and disadvantages of these parties in dispute

- prepare material for solving a concrete case

 

Evaluation

After successfully completing the course, students will be able to:

- compare different legal institutes of the general part of civil law and law of obligations that are available for solving concrete cases

- recommend an optimal manner of realising subjective civil rights in the area of the law of obligations

- conclude which are the consequences of applying individual institutes of the general part of civil law and law of obligations

Practical and Generic Skills:

After successful completion of the course students will be able to:

 

- find relevant legal sources,

- research court practice,

- express their own opinion about the application of legal rules to concrete cases,

- formulate the contents of pledings for the purpose of realisation and protection of subjective rights, contracts and other legal acs,

- prepare names and unnamed contracts,

- write professional and scientific papers,

- participate in the work of a team during solving cases,

- use e-learning systems.

Matching Assessments to Learning Outcomes:

Learning outcomes are tested in a manner so that students independently or in a team solve concrete cases and complete writing tasks (f.e. contracts). Apart from that, learning outcomes of analysis, synthesis and evaluation are tested through the grade of seminar papers, and knowledge and understanding is tested by a mid-term examination. On the basis of all learning outcomes, the final grade is determined.

E-learning system Merlin is used for the distribution of teaching materials, testing of knowledge and mid-term examination.
