Description:

Concept, principles, system and sources of civil law. Civil law relation. Civil rights in subjective sense. Subjects of civil law. Objects of civil law. Legal acts. Acquisition and termination of rights. Introduction to property law. Possession. Ownership. Servitudes, real encumbrances, building rights, pledges. Land registers. Concept and types of obligations, concept and formation of contract, classification and types of contracts. Liability for material and legal defects of performance, deposit, right of retention; guarantee, contractual penalty. Modification in obligations (subjects and content). Termination of obligations. Liability for damages. Unlawful enrichment. Contracts. Succession law (concept, principles and prerequisites). Intestate succession. Testamentary succession.

Knowledge and understanding

After successful completion of the course, students will be able to:

- define civil law system,

- define and explain individual institutes and concepts of the general part of civil law, law of obligations, property law and law of inheritance

- recognise and explain the scope of application of legal rules and prerequisites for the application of individual legal institutes of civil law - general part,property law, the law of obligations and law of inheritance.

 

Application

After successfully completing the course, students will be able to:

- properly interpret rules that regulate general part of civil law, law of obligations, property law and law of inheritance

- determine which legal rules are relevant for solving a concrete case

- apply legal rules to solving professional legal problems

 

Analysis

After successfully completing the course, students will be able to:

- analyse legal sources and legal rules that determine the subject matter of the general part of civil law, law of obligations, property law and law of inheritance

- connect basic concepts and contents of legal rules that regulate individual civil law institutes

- distinguish and compare individual civil law institutes

 

Synthesis

After successfully completing the course, students will be able to:

- connect relevant facts with legal rules and on the basis of that determine the rights and obligations of legal subjects

- collect, interpret, assess, select and creatively use various facts, basic concepts and procedures in solving tasks from the area of general part of civil law, law of obligations, property law and law of inheritance

 

Evaluation

After successfully completing the course, students will be able to:

- compare basic concepts of legal institutes of the general part of civil law, law of obligations, property law and law of inheritance that are available for solving concrete cases

- evaluate which are the basic consequences of applying individual institutes of the general part of civil law, law of obligations, property law and law of inheritance

Practical and Generic Skills:

After successfully completing the course, students will be able to:

 

- find relevant legal sources

- express their own opinion aboutz the application of legal rules in concrete cases

Matching Assessments to Learning Outcomes:

Learning outcomes are tested by an oral examination. Within oral examination intellectual (cognitive) skills of the student are tested. Oral examination consists of an interview with the student within which learning outcomes connected with analysis, synthesis and evaluation are tested. Students are questioned about relevant contents and basic legal terms from the general part of civil law, law of obligations, property law and law of inheritance. Students are encouraged to give examples for the purpose of developing practical application of acquired knowledge and expressing their own opinion about the application of basic legal rules in concrete cases. A final grade is given for the examination.
