Description:

Due to social disturbances and war events, there is a growing need for special protection of an extremely vulnerable group of children - the unaccompanied children. The aim of the course is to familiarize students with the rights of unaccompanied children, with the international standards for their protection and with the national legal system of the Republic of Croatia. Students will learn about the role of international organizations, the application of the Convention on the Rights of the Child, with particular emphasis on the specificity and vulnerability of this group of children, the system of family protection of unaccompanied children, the social protection system and the exposure of unaccompanied children to trafficking. The course will show the development of the legal framework for protection within the European Union and the Council of Europe, with particular reference to the judicature of the European Court of Human Rights. Students will learn about the procedures of protecting the rights of unaccompanied children, with an emphasis on administrative procedures, and will have an insight to the experiences and practices of state institutions and non-governmental organizations in the protection of unaccompanied children, especially those seeking asylum or subsidiary protection.

Cognitive Skills:

Upon successful completion of the course students will:

 

• be well acquainted with all elements of the protection of unaccompanied children
• be able to define and evaluate the rights of unaccompanied children,
• be able to determine the basic principles of international legal sources governing the protection of unaccompanied children,
• be able to clarify the role of the welfare system in the protection of unaccompanied children
• be able to describe and clarify the legal status and procedural rights of unaccompanied children in various proceedings before state bodies
• be able to examine and explain the role of competent authorities in the protection of unaccompanied children
• be able to judge the quality of the legal protection for unaccompanied children in practice
• be able to effectively apply the system of protection of unaccompanied children.

Practical and Generic Skills:

- the ability to think critically about key family law, procedural law and international law issues related to the protection of unaccompanied children

 

- the ability to correctly apply the provisions of international and national legal sources in practice

 

It is expected that students will be able to reasonably reflect and draw conclusions concerning measures of protection of unaccompanied children, given that the remedies available for protection originate from different branches of law, and in practice are successfully achieved only through the cooperation of different competent authorities (eg. police, social welfare centers and homes for the education of children and youth or shelter for asylum seekers). The learning process should also be completed by understanding the need to acquire specific knowledge in order to effectively protect unaccompanied children.

Matching Assessments to Learning Outcomes:

The final grade of the exam is the average grade obtained from the written essay and the oral exam.

The essay is considered to be a confirmation that the student has mastered the basic principles of Family law protection of unaccompanied children. Based on the relevant literature, the student needs to analyze relevant facts and draw his/her own conclusions in relation to the topic of the essay. The student is expected to have a good understanding of the matter, as well as to draw legally reasoned conclusions. The essay is evaluated according to the usual criteria for evaluating student papers: good choice of the topic of the essay, appropriate use of the relevant literature, appropriate structure of the essay, comprehensive presentation of thoughts and conclusions, with appropriate citing of sources in footnotes and references. Students are expected to present their essays orally. Essays are graded with grades from insufficient to excellent.

The oral exam is a conversation with a student, during which the understanding of the matter and the connection of facts are required. The oral examination is more than an accurate reproduction of the learned facts because the student is required to have a good understanding of the basic institutes of Family law protection of unaccompanied children as well as to provide a meaningful and reasoned explanation of his/her answers, using adequate legal argumentation. As a rule, the final grade is the average grade obtained from the essay and the oral exam. However, in cases where one segment is significantly more successful than the other, it is possible to achieve a grade higher than the one obtained by mathematical calculation.
