Description:

The subject-matter of transport insurance is of a particular importance for everyday unhindered flow of domestic and international trade. The carriage of goods - the basic modus operandi of international trade - heavily depends on the availability and financial affordability of different types of insurance utilized by various stakeholders for cases of unwanted damage. The main goals of Transport Insurance Law course are directed towards: - enabling the understanding of insurance legal framework in the field of land, air and marine insurance, - examining the typical general transport and marine insurance contracts, and difference between general transport and marine insurance from other types of insurance, - applying the transport insurance law legal institutes on practical examples.

After successfully completing the course, students will be able to:

-  identify specific risks involved in transport industry and find appropriate insurance coverage for it;

- distinguish between specificities of land, air and marine insurance

- identify parties incurring specific risks in transport interested in buying the insurance coverage

- identifying the underlying normative framework for every type of insurance coverage involved

- distinguish between the cargo and liability insurance, as well as compulsory and non-compulsory insurance in solving practical cases

Analysis

After successfully completing the course, students will be able to:

- identify different specific risks involved in land, air and marine transport

- differentiate between the premium-based and mutual insurance and its role in modern transport insurance

- understand the underlying industry interests vested in transport and marine insurance

- understand the importance of the transport and marine insurance for the protection of the environment, as well as support to the industry with respect to new emerging risks

- understand the role of the insurance industry in ensuring the long-term competitiveness and sustainability of the transport and shipping industry

- understand the hierarchy of different sources of law on the international, EU and national law in the ambit of transport and marine insurance law

Synthesis

After successfully completing the course, students will be able to:

- understand and discuss the connection between the international trade, transport industry and transport and marine insurance industry and the underlying interests,

- understand the importance of transport and marine insurance industries for modern commerce and normal functioning of international trade

- identify modern-day challenges to transport and shipping industries and the role of insurance industry in countering them

- identify main types of contracts with respect to the insured risks in transport and marine insurance

- solve simple cases involving institutes of transport and marine insurance.

Practical and Generic Skills:

After successfully completing the course, students will be able to:

- understand the importance of insurance law in general, and transport and marine insurance in particular with respect to the interests of the industry involved:

-define the normative framework applicable to marine and transport insurance on the International, EU and national level:

- define typical insured risks in transport and marine insurance and the underlying contracts;

- explain the rights and obligations under the typical contracts in transport and marine insurance

- explain the importance and institutes of cargo insurance, in context of international trade

- explain the institute of hull& machinery insurance;

- explain the role and particulars of the professional liability insurance in land and air transport

- explain the specificities of the P&I insurance and its importance for modern shipping;

- distinguish between the compulsory and non-compulsory insured risks in transport and marine insurance,

- define the applicable legal norms in different cases of compulsory insurance and the right to direct action

- explain the purpose of reinsurance in international trade.

After successfully completing the course, students will be able to:

- discuss the main interests and corresponding insurance institutes in transport and marine insurance

- identify the appropriate legal solution to main problems arising with respect to transport and shipping practice

- evaluate the legal norms applying to issues involving transport and marine insurance and find solutions to possible problems and legal deficiencies
