Description:

The aim of the course is for students to attain basic knowledge of the EU legal system. The course will focus on the EU's institutional structure, decision-making, competences, legal sources and their effects on domestic legal orders. It will also provide the basics of EU internal market law, fundamental rights and freedoms in the EU and EU external relations law. All topics will be examined by relying on case-law of the Court of Justice of the European Union and by placing the discussion in the context of the most recent and burning developments in Europe.

Cognitive Skills:

Knowledge and understanding of law

 

- to understand economic, political and social circumstances in which the EU was established and in which it is operating, and which influence the functioning of Europeaninstitutions;

- to understand the role and powers of the EU institutions and procedures held before the European Court;

- to identify types of legal sources of European law and explain their effects;

- to show understanding of material European law, especially the law of internal market;

- to understand the purpose of division of powers between member states and the EU, and to distinguish the areas of application of national law and European law;

- to understand the reasons for introducing the protection of human rights in the legal system of the EU, to understand its purpose and to understand the relation between national human rights guarantees, EU guarantees and the European Convention of Human Rights;ž- to understand the concept of European citizenship and its importance in European law;

- to understand the relation between market freedoms and fundamental rights in the EU and methods of their balancing by the European Court;

- to understand the powers of the European Union in relations with third countries, including the power to conclude international treaties, their efefcts and manner of interpretation

Practical and Generic Skills:

Legal skills

- to recognise legal problems in European law

- to analyse and solve legal problems through the application of primary and secondary sources of law and other legal material on a complex factual situation;

- to analyse and assess conflicting interpretations of law and court practice on the basis of the application of the rule of interpretation;

- to analyse and assess law and legal reform in social, economic, political and moral context:

- to critically consider and argument legal problems with the awareness of the existence of different standpoints;

- to present argumented legal opinions supported by legal sources

 

Practical skills

- to determine a legal problem for a seminar paper and conduct a research using different research tools, including libraries and the INternet

- to plan a research, including prioritising according to the relevance for the seminar paper

- to plan and conduct an independent student research project

 

Communication skills

- to articulate and express ideas in an appropriate and clear manner, orally and in writing;

- to read and understand complex legal materials;

- to apply communication skills in different situations
