Constitutive elements of the constitutional notion of fundamental rights and freedoms; specific content protected by fundamental rights and freedoms in comparative constitutional law and division into possible categories - personal (civil), political, economic social, cultural, ecological and other rights and freedoms; legal sources - constitution as basic and other legal acts (constitutional laws, organic laws) as additional sources of protection of fundamental rights and freedoms (2 hrs)
Judicial review mechanism as element of the notion of fundamental rights and freedoms; specialized institutions of protection of fundamental rights and freedoms in constitutional law (2 hrs)

II.DEVELOPMENT OF THE CONCEPT OF FUNDAMENTAL RIGHTS AND FREEDOMS IN COMPARATIVE CONSTITUTIONAL LAW
Enactment of declarations on rights and freedoms and first democratic constitutions in comparative constitutional law: the American 1776 Declaration of Independence; the 1787 United States Constitution; the 1791 Bill of Rights; the French 1789 Declaration of the Rights of Man and of the Citizen; the 1919 Weimar Constitution, the 1990 Constitution of the Republic of Croatia; constitutions of new European democracies in 1990s (2 hrs)
Further development of constitutional documents and the period of "legislative supremacy" in the field of protection of rights and freedoms: amendments to the United States Constitution; preamble to the 1946 French Constitution; the 1958 French Constitution; the 1949 German Basic Law, amendments to the 1990 Croatian Constitution; comparative constitutional law (2 hrs)
Period of "constitutional supremacy" in the field of protection of rights and freedoms; full development of the judicial review mechanism and creation of the true concept of constitutionally protected "fundamental rights and freedoms"; examples from the United States of America, France, Federal Republic of Germany and Republic of Croatia; selected examples from the comparative constitutional law (2 hrs)

III.THE JUDICIAL REVIEW MECHANISM IN PRACTICE: SELECTED EXAMPLES OF FUNDAMENTAL RIGHTS AND FREEDOMS PROTECTION
The United States of America: the "doctrine of incorporation" of constitutional rights and freedoms; the US Supreme Court - the "Rationality Review" and the "Strict Scrutiny Review"; the US Supreme Court case-law (6 hrs)
France: the process of incorporation of fundamental rights and freedoms; the French Constitutional Council - the "manifest error" (L'erreur manifeste d'préciation) standard and the proportionality (Le contrôle de proportionnalité) test; the Constitutional Council case-law (4 hrs)
